How often must a server be certified?
Every three years. Upon completion of the alcohol server training course, each participant will receive a numbered certificate which is valid for three years from the date of issuance.
How old do I need to be in order to obtain a server permit?
In New Mexico, you must be at least 19 years old to attend an alcohol server training class and receive a server permit. Additionally, you must be at least 19 years old to serve alcohol in a bar or restaurant environment, and at least 21 years old to sell package alcohol, such as in a liquor store or supermarket.

What is a server?
Any individual who sells or serves alcoholic beverages for consumption on or off the premise of a business that is licensed under the provisions of the Liquor Control Act. By regulation, the Division has included persons who manage, direct, or control the sale or service of alcoholic beverages. This includes personnel who are responsible for checking identification.
What is a Certified Alcohol Server Program?
The Alcohol and Gaming Division's Advisory Committee certifies Alcohol Server Programs. In addition to this website course, the Alcohol and Gaming Division provides a list of certified programs that provide face-to-face training. The dates courses are offered is available by calling their office. A certified face-to-face course must last a minimum of four and a half hours of class time and cover specified subjects.
May a licensee employ a server who is not certified?
Yes, but only temporarily. The Liquor Control Act requires the server to be certified within thirty (30) days of being employed as a server.
What are the requirements for proof of certification?
May a person who does not have a liquor license allow his customers to bring and consume their own alcoholic beverages (B.Y.O.B.) at his business establishment?
No. It's a crime for any person who doesn't hold a liquor license to permit the consumption of alcoholic beverages in his public establishment or private club. In addition, it is a crime for any person to consume alcoholic beverages at any public establishment unless it is licensed to sell alcoholic beverages. [60-7A-22, N.M.S.A.]
How do I renew my server's permit in New Mexico?
You may have received an email from us telling you that your permit will expire in 30 days. if so, here’s what to do: Go to the Way To Serve home page at https://www.waytoserve.org. Instead of trying to log in, you will choose your state in the top section of the page. Under “Select State…” select New Mexico or New Mexico-Spanish in the drop down list, click Register Now, and then fill out all the registration information. Check the Renewal option on the New or Renewal Certification drop-down list. You can use your same email (or a different one), and you can use your same password although it wouldn’t hurt to make a new one. Then go on to the Payment page and when you’ve paid you can start the course. You must complete the entire course to receive your renewed permit. Your temporary permit will be recognized as valid after its expiration, if you have not yet received your permanent permit from the State of New Mexico.
